Public comments are received during the Oral Communications section of the agenda. No action may be taken on off-agenda items unless authorized by law. Public comments for Public Hearings will only be taken at the time of the hearing. It is requested to state your name for the record, then proceed to address the Council/Board. All speakers shall observe civility, decorum, and good behavior.

Members of the public may address the Council/Board on any agenda item before or during Council/Board’s consideration of the item, and on any other matters within the Council/Board´s jurisdiction by using any of the following methods:

Recommended Action: It is recommended that the City Council: 

Adopt Ordinance No. O-2026-03, An Ordinance of the City Council of the City of Placentia, California, granting to Crimson California Pipeline, L.P., a franchise to operate and maintain certain pipelines and appurtenances for the transportation of hydrocarbon substances in the City of Placentia

AMENDMENT NO. 1 TO MAINTENANCE SERVICES AGREEMENT WITH BEAR ELECTRICAL SOLUTIONS, INC. FOR TRAFFIC SIGNAL MAINTENANCE SERVICES

 

Fiscal Impact:
Expense: $420,000 Amendment No. 1 Additional Contract Amount over 2-Years

 

Recommended Action: It is recommended that the City Council:

  1. Approve Amendment No. 1 to the Maintenance Services Agreement with Bear Electrical Solutions, Inc. for Traffic Signal Maintenance Services, increasing the contract capacity by $420,000, resulting in a new not-to-exceed amount of $930,000; and
  2. Authorize the City Administrator to approve contract change orders up to 10% of the initial three-year contract amount; and
  3. Authorize the City Administrator to execute the necessary documents, in a form approved by the City Attorney.

AMENDMENT NO. 1 TO PUBLIC WORKS AGREEMENT WITH RJ NOBLE COMPANY FOR CONSTRUCTION SERVICES RELATED TO THE FY 24-25 RESIDENTIAL STREET REHABILITATION PROJECT

CONSIDERATION OF VESTING TENTATIVE TRACT MAP NO. 19467 FOR THE SUBDIVISION OF A 2.72-ACRE PROPERTY TO CREATE 75 RESIDENTIAL CONDOMINIUM UNITS, INCLUDING FIVE LIVE-WORK UNITS, LOCATED AT 777 W. ORANGETHORPE AVENUE AND 776 S. PLACENTIA AVENUE (APN 339-112-27)

 

Fiscal Impact:

$1,657,634 Development Impact Fees

 

Recommended Action: It is recommended that the City Council:

  1. Find that Vesting Tentative Tract Map No. VTTM 19467 is statutorily exempt from the California Environmental Quality Act (CEQA) pursuant to Public Resources Code Section 21080.66 (AB 130 – Infill Housing Development Projects); and
  2. Adopt Resolution No. R-2026-17, A Resolution of the City Council of the City Of Placentia, California, adopting the California Environmental Quality Act (“CEQA”) Statutory Exemption, California Public Resources Code § 21080.66 (Ab 130 – Infill Housing Development Projects), and approving Vesting Tentative Tract Map No. VTTM 19467 for the subdivision of the subject property for the purpose of creating 75 residential condominium units on a 2.72-acre previously developed site, on property located at 777 W. Orangethorpe Avenue and 776 S. Placentia Avenue (APN 339-112-27).

APPROVAL OF ORANGE COUNTY ANIMAL CARE SERVICES AGREEMENT

 

Fiscal Impact:

Approximately $487,925 per year. 

 

Recommended Action: It is recommended that the City Council:

  1. Approve the Master Agreement for the Provision of Orange County Animal Care Services (OCACS) between the City of Placentia and the County of Orange for the period covering May 31, 2026, through May 30, 2031; and
  2. Authorize the City Administrator to execute the necessary documents, in a form approved by the City Attorney.

APPROVAL OF THE WASTE INFRASTRUCTURE SYSTEM ENTERPRISE (WISE) AGREEMENT WITH ORANGE COUNTY WASTE & RECYCLING FOR MUNICIPAL SOLID WASTE DISPOSAL RATES AND SERVICES 

 

Fiscal Impact:

None.

 

Recommended Action: It is recommended that the City Council:

  1. Approve the attached WISE Agreement with the County of Orange for municipal solid waste disposal rates and services; and
  2. Authorize the City Administrator, or designee, to execute the agreement on behalf of the City and make minor modifications as necessary.

ADOPTION OF PROPOSED COMPREHENSIVE FEE AND RATE SCHEDULE 

 

Fiscal Impact:

The proposed fee changes as of July 1, 2026, are intended to recover the cost of providing existing services associated with fee-related regulatory functions and other programs.

 

Recommended Action: It is recommended that the City Council:

  1. Open the Public Hearing to consider amending the Placentia Comprehensive Fee Schedule for certain fees, rates, and charges for various City user services; and
  2. Receive the Staff report, consider all public testimony, and discuss the proposed fees; and
  3. Close the public hearing; and
  4. Adopt Resolution No. R-2026-18, a Resolution of the City Council of the City of Placentia, California, establishing and adopting certain City fees, rates, and charges for various City services with an effective date of July 1, 2026, for Fiscal Year 2026-27.

PUBLIC HEARING FOR THE ANNEXATION OF PROPERTIES INTO COMMUNITY FACILITIES DISTRICT NO. 2014-01 (PUBLIC SERVICES)

  1. Open the Public Hearing concerning Resolution No. R-2026-19; and
  2. Receive the Staff report and consider all public testimony; and

  4. Adopt Resolution No. R-2026-19, A Resolution of the City Council of the City of Placentia, California, ordering the annexation of territory to its Community Facilities District No. 2014-01 (Public Services) (Annexation 2026-01) and approving the amended map for said District.

  4. Adopt Resolution No. R-2026-20, a Resolution of the City Council of the City of Placentia, California, ordering the annexation of territory to its Landscape Maintenance District No. 92-1 (Annexation 2026-01) and approving the amended map for said District.

APPEAL OF THE DECISION OF THE PLANNING COMMISSION TO REVOKE SHORT-TERM RENTAL PERMITS STR 2020-10 AND STR 2020-11 AND ASSOCIATED BUSINESS LICENSES FOR PROPERTY LOCATED AT 607 ENCINITAS WAY, UNITS A & C

 

Fiscal Impact:

Recovery of $17,797.83 in Transient Occupancy Tax owed. Potential for approximately $15,000 in additional annual Transient Occupancy Tax revenue if the STR permits are reinstated.

 

Recommended Action: It is recommended that the City Council:

  1. Open the Public Hearing concerning revocation of Short-Term Rental permits STR 2020-10 and STR 2020-11 and associated business licenses for property located at 607 Encinitas Way, Units A & C; and
  2. Receive the Staff Report, consider all Public Testimony, ask any questions of Staff; and
  3. Close the Public Hearing; and
  4. Find that this action is not subject to CEQA pursuant to State CEQA Guidelines § 15321 (Class - 21 Enforcement Actions by Regulatory Agencies); and
  5. Approve the agreement between the City of Placentia and Alexander/Celenia Perez in which outstanding Transient Occupancy Tax (TOT) owed to the City of Placentia would be paid. Authorize the City Administrator or her designee to finalize said agreement; and approve the appeal and reverse the Planning Commission revocation of Short-Term Rental
    Permits STR 2020-10 and STR 2020-11 and reinstate associated business licenses for the property located at 607 Encinitas Way, Units A and C.

UPDATE REGARDING CITYWIDE DEVELOPMENT IMPACT FEES, TRANSIT ORIENTED DEVELOPMENT PACKINGHOUSE DISTRICT DEVELOPMENT IMPACT FEES, AND AFFORDABLE HOUSING IMPACT FEES, INCLUDING ADOPTION OF NEW GENERAL GOVERNMENT FACILITIES FEES FOR COST RECOVERY

 

Fiscal Impact:

The adoption of revised development impact fees and residential affordable housing impact fees will not have an immediate impact on revenues to the City as they are effective 60 days subsequent to adoption. These Development Impact Fees are established for cost recovery or statutory purposes only.

 

Recommended Action: It is recommended that the City Council:

  1. Open the Public Hearing concerning the Citywide Development Impact Fee Schedule including adoption of new General Government Facilities fees, the Transit-Oriented Development (TOD) Packing House Development Impact Fee Schedule, and the Affordable Housing Impact Fee Schedule; and
  2. Receive the Staff report, consider all public testimony, ask questions of Staff; and
  3. Close the public hearing; and
  4. Find that the recommended actions are exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15061(b)(3), 15273, and 15378(b)(4) of the CEQA Guidelines, Section 21065 of the Public Resources Code, and the City of Placentia Local Guidelines for implementing CEQA; and
  5. Adopt Resolution No. R-2026-22, a Resolution of the City Council of the City of Placentia, California, approving updated Development Impact Fees pursuant to Construction Cost Index to financially mitigate impacts to parks and recreational facilities, sewer facilities, transportation infrastructure, storm drain facilities, Quimby in-lieu fees, Public Safety (Fire, Police, Animal Shelter), Streetscape (Transit Oriented Development), and adopting General Government Facilities fees citywide pursuant to the April 2026 Development Impact fee Nexus; adopt a Capital Improvement Plan for the impact fees; and determine that the adoption of the Development Impact Fees and Capital Improvement Plan is exempt from the California Environmental Quality Act; and
  6. Adopt Resolution No. R-2026-23, a Resolution of the City Council of the City of Placentia, California, approving  updated Affordable Housing Impact fees pursuant to Construction Cost Index for residential and non-residential developments citywide; and determine that the adoption of the Affordable Housing Impact fees is exempt from the California Environmental Quality Act; and
  7. Consider first reading of Ordinance No. O-2026-05, an Ordinance of the City Council of the City of Placentia, California, amending Title 5  of the Placentia Municipal Code (schedule of fees) to add Section 5.02.105 “General Government Facilities Fees” establishing a City Facilities Impact Fees as part of the City’s Development Impact Fee Program, and adopting necessary findings for the Establishment of the City Facilities Impact Fees; and
  8. Consider first reading of Ordinance No. O-2026-08, an Ordinance of the City Council of the City of Placentia, California, amending Title 5 of the Placentia Municipal Code (Schedule Of Fees) by amending Chapters 5.01 (Fees Set by Resolution), 5.03 (Transit Oriented Development (TOD) Development Impact Fees), 5.12 (Fire Department) and 5.24 (Public Works Department) as part of the City’s Development Impact Fee Program.

DISCUSSION REGARDING SHORT-TERM RENTAL REGULATIONS IN THE CITY OF PLACENTIA AND CONSIDERATION OF ORDINANCE NO. O-2026-04, AN ORDINANCE OF THE CITY OF PLACENTIA, CALIFORNIA, AMENDING PLACENTIA MUNICIPAL CODE CHAPTER 6.45 RELATED TO SHORT-TERM RENTALS

 

Fiscal Impact:

Potential for approximately $235,000 in revenue annually from Transient Occupancy Tax, based on FY 24-25 actuals.

 

Recommended Action: It is recommended that the City Council:

  1. Receive the Staff report; and
  2. Conduct discussion regarding Short-Term Rental regulations in the City of Placentia; and
  3. Find that Ordinance No. O-2026-04 is not subject to CEQA pursuant to Sections 15060(c)(2), 15060(c)(3) and/or 15061(b)(3) of the State CEQA Guidelines; and
  4. Consider first reading of Ordinance No. O-2026-04, an Ordinance of the City of Placentia, California, amending Placentia Municipal Code Chapter 6.45 related to Short-Term Rentals.
